    2026-UNAT-1678, Imad Hassanein

The staff member, who was serving in Khartoum, was evacuated when civil war erupted in Sudan. He submitted a claim for compensation for loss of personal effects attributable to service.

The UNAT held that by denying the staff member’s request for referral to mediation the UNDT had lawfully exercised its case management discretion and had not committed an error of procedure.

The UNAT found that the UNDT had not erred when it identified the staff member’s argument as a challenge to the policy of the Organization but had erred when it held that it did not have jurisdiction to incidentally examine...

    2026-UNAT-1675, Elizabeth Isabiti Opero

The staff member, who was serving in Khartoum, was evacuated when civil war erupted in Sudan. She submitted a claim for compensation for loss of personal effects attributable to service.

The UNAT held that the UNDT had not erred, such as to affect the decision of the case, when it rejected the parties’ joint motion to refer their case to mediation.

The UNAT found that the UNDT had not erred when it identified the staff member’s argument as a challenge to the policy of the Organization but had erred when it held that it did not have jurisdiction to incidentally examine the consistency of...

    2026-UNAT-1641, ABN

Although the Secretary-General was not a party to the impugned Order, the UNAT held that the Secretary-General had a direct and cognizable interest in an appeal which considers whether the UNDT is entitled to determine whether his legal representative should be disbarred from appearing in future cases and unrelated cases before the UNDT. If the UNDT is empowered to order as much, it raises a significant risk of harm to the Secretary-General’s authority to appoint staff members to perform legal functions, allocate its legal resources, and hold staff members accountable in accordance with the...

    2025-UNAT-1561, HUDA HANNINA

The UNAT observed that the UNDT did not err in denying the staff member’s request for an oral hearing as the case record was “comprehensive” and there was “no irreconcilable dispute of facts between the parties.”

The UNAT held that the staff member’s placement on ALWP was justified, given that the staff member was provided with the names of the members of the fact-finding panel assigned to investigate her alleged misconduct, and that she was in a position to approve the consultancy contract of one of those members, which created a conflict of interest and a genuine risk of interference in the...

    029 (NY/2025), SAMARASINHA

The Tribunal took note of the Applicant’s preference to have this case adjudicated in New York since he was “partially resident” in the United States with his family. However, having reviewed all of the arguments advanced by the parties since the filing of the case with the New York Registry, particularly the official documents provided by Counsel for the Respondent, the Tribunal considered that it was appropriate and in the interest of justice to transfer the case to the Geneva Registry. The Tribunal was also satisfied that the Applicant would not be prejudiced by the transfer of the case to...

    009 (NY/2024), Applicant

The Tribunal reviewed the supporting documents filed by the Applicant and understood that she was facing personal circumstances that affected her ability to review court documents and prepare submissions as a self-represented Applicant. The Tribunal was also mindful of the Applicant’s right of access to the internal system of justice. At the same time, the Tribunal could not continue extending routine filing deadlines and delay the proceedings indefinitely.

The Tribunal considered that the interests of justice, including those of both parties, obliged it to adjudicate the case as expeditiously...

    2024-UNAT-1499, Philippe Schifferling

The Appeals Tribunal dismissed both appeals.

The Appeals Tribunal held that the UNDT correctly found that the Charge Letter did not constitute a reviewable administrative decision, and that as such Mr. Schifferling’s application was not receivable ratione materiae.

The Appeals Tribunal further found that the question of whether the Dispute Tribunal erred in not joining the Secretariat as a necessary party to the application had become moot and that in any event, the interlocutory appeal was not receivable.

    UNDT/2024/007, Aguilar Valle

Considering the lack of any direct evidence before the Tribunal as the alleged victim declined to provide witness testimony, it found that the Respondent had not managed to prove with clear and convincing evidence, or even with the preponderance of evidence, the factual allegations leading to the USG/DMSPC’s conclusion that the Applicant had sexually harassed her. In the same vein, the Respondent also failed to demonstrate that the Applicant created a hostile work environment for her.

Whereas the Applicant’s actions and behavior were not up to the standard to be expected of a supervisor...

    UNDT/2024/047, Argyrou

The Tribunal noted that the Applicant’s challenges/complaints did not derive from one clear administrative decision. The first challenge was addressed to an alleged failure by the Administration to fully comply with sec. 2.4 ST/AI/1998/9 (System for the classification of posts). The second one was based on the Applicant’s apparent assumption that he should have been upgraded/promoted to GS-7 level after the upward reclassification of the post he was encumbering.

As a result, the Tribunal interpreted the application as a whole to determine exactly the starting point of the Applicant’s...

    2024-UNAT-1452, Ousmane Tamba Dia

The UNAT held that the UNDT did not commit any error in procedure that affected the outcome of the case by partially denying the former staff member’s motions for production of additional evidence or by not granting him sufficient additional time to respond to the Secretary-General’s submissions.

The UNAT also concluded that the UNDT appropriately identified the contested decision as the 1 April 2022 decision finding him ineligible to participate in ASHI. The UNAT observed that the former staff member himself identified this decision in both his UNDT application and his management evaluation...
