The UNAT held that the UNDT committed no error in its conduct of the hearing. In this regard, the UNAT observed that UNICEF Uganda was requested to provide a suitable venue from which the UNDT Judge could conduct the hearing solely for connectivity reasons, and that the Secretary-General¡¯s counsel participated from the United Kingdom and was therefore, contrary to the former staff member¡¯s contention, not in proximity to the Judge. It further found that the fact that the Judge did not keep her camera on at all times during the hearing did not demonstrate that she was not appropriately...

The UNAT held that the UNDT did not err in refusing to call an expert witness to demonstrate that the former staff member¡¯s personal information had been improperly leaked by other UNICEF staff members with access to Vision, a system that stores UNICEF staff information. The UNAT found that the investigators¡¯ conclusion that it was not possible to identify the staff member, if any, who had leaked the former staff member¡¯s personal information to a third party stood unrefuted. It further found that it had not been shown that, had the investigators sought third-party expert assistance, they...

The staff member, who was serving in Khartoum, was evacuated when civil war erupted in Sudan. He submitted a claim for compensation for loss of personal effects attributable to service.

The UNAT held that by denying the staff member¡¯s request for referral to mediation the UNDT had lawfully exercised its case management discretion and had not committed an error of procedure.

The UNAT found that the UNDT had not erred when it identified the staff member¡¯s argument as a challenge to the policy of the Organization but had erred when it held that it did not have jurisdiction to incidentally examine...

The staff member, who was serving in Khartoum, was evacuated when civil war erupted in Sudan. She submitted a claim for compensation for loss of personal effects attributable to service.

The UNAT held that the UNDT had not erred, such as to affect the decision of the case, when it rejected the parties¡¯ joint motion to refer their case to mediation.

The UNAT found that the UNDT had not erred when it identified the staff member¡¯s argument as a challenge to the policy of the Organization but had erred when it held that it did not have jurisdiction to incidentally examine the consistency of...

The UNAT held that the issues on appeal were whether it had jurisdiction to entertain appeals against interlocutory orders of the UNRWA Dispute Tribunal, whether the impugned orders fell within the narrow exceptional category of appealable interlocutory decisions, and whether the UNRWA Dispute Tribunal acted without jurisdiction or in excess of its powers in issuing the contested directions. The UNAT recalled that its role is not to intervene in case?management matters, but to determine whether an interlocutory order is exceptionally appealable because it is ultra vires, dispositive of an...

The UNAT held that the issues on appeal were whether the UNDT had clearly exceeded its jurisdiction or competence in issuing the impugned interlocutory case?management orders, and whether any alleged procedural errors were effectively irremediable by a final judgment or manifestly unreasonable so as to justify interlocutory review. It recalled that appeals against interlocutory orders are receivable only in rare and exceptional circumstances, and that matters relating to evidence, procedure, and trial conduct fall within the UNDT¡¯s broad case?management discretion.

The UNAT found that the UNDT...

The UNAT held that the UNDT correctly determined that the former staff member¡¯s claims for compensation under Appendix D based on UNAMID living conditions were not receivable because he had not exhausted mandatory medical review remedies. The UNAT reaffirmed the principle that staff members must exhaust internal remedies before resorting to litigation.

The UNAT further held that the UNDT erred in reviewing the merits of the x?ray machine injury claim while a medical board review was pending. The UNAT found that both elements of the Appendix D claim were premature and should have been declared...

The UNAT held that the UNDT properly exercised its discretion in excluding the former staff member¡¯s allegations of racism within the CAF and his claim that his counsel was treated unfairly during the UNDT hearing, as well as in denying his request to call the investigator to testify. Nevertheless, the UNAT concluded that the UNDT erred in finding that the facts underlying the alleged misconduct had been proven by clear and convincing evidence, particularly in its assessment of the credibility of the witnesses.

Regarding V01¡¯s allegations, the UNAT found that the UNDT improperly explained away...

The UNAT affirmed the UNDT¡¯s decision to dismiss the former staff member¡¯s request for anonymity, as he had ignored the deadline set by the UNDT in an Order.

The UNAT found that the former staff member committed sexual exploitation by engaging in a romantic and sexual relationship with a vulnerable refugee, who put herself in danger in engaging in a premarital relationship with him. He abused his position of trust by promising to marry her to persuade her to have sexual relations with him. When she pushed him about his promises, he threatened her with an investigation that could result in the...

The Tribunal acknowledges the Applicant¡¯s circumstances and has no intention of jeopardizing his health in any way. At the same time, it considers the Applicant¡¯s active participation in the proceedings essential to ensuring the fair adjudication of his case. The Tribunal concurs with the Respondent¡¯s assertion that ¡°the right to institute and pursue legal proceedings is contingent upon the individual exercising this right having a legitimate interest in initiating and sustaining legal action.¡± The Applicant voluntarily initiated these judicial proceedings and, as such, has a vested interest...
