The Appeals Tribunal found that Ms. Prodanovic had met the criteria for a continuing appointment and that under the applicable legal framework, the award of a continuing appointment was not subject to the Secretary-General's discretion. The UNDT therefore correctly held that the decision not to grant her a continuing appointment was unlawful.

The Appeals Tribunal however found that the granting of a continuing appointment was not an "appointment" for the purpose of Article 10(5)(a) of the UNDT Statute, and that the UNDT had erred in awarding in-lieu compensation.

The Appeals Tribunal found that the UNDT erred in law when it awarded in-lieu compensation in the amount of 6 months' net base salary without providing reasons to support said amount. The Appeals Tribunal found that had Mr. Isufi's appointment not been unlawfully not renewed and all other relevant considerations being equal, he might reasonably have expected to have enjoyed another one-year fixed-term appointment. Factoring in a variety of applicable contingencies, including his known history of consistent and repeated less-than-satisfactory performance, together with the other usual...

The UNAT found the UNRWA DT erred in law and in fact, resulting in a manifestly unreasonable decision, when it failed to properly consider Section 66 of UNRWA Area Personnel Directive No. PD/A/4/Part II/Rev. 7/Section I, which is geared toward ensuring gender balance, and when it took the irrelevant consideration of the recommendation of the third candidate into account, leading it to erroneously set Ms. Al Dawoud¡¯s chances for selection at 50 per cent instead of 100 per cent. The UNAT held that Section 66 expresses a preference for selection of candidates who are in the under-represented...

The Appeals Tribunal granted the Secretary-General¡¯s appeals, dismissed Mr. Heurtematte¡¯s appeal and reversed the UNDT Judgments.

The Appeals Tribunal found that the UNDT¡¯s largely speculative grounds for concluding ulterior motives by UN Women were not justified, especially when compared to the compelling contemporaneous reasons for the abolition, i.e. the fact that UN Women no longer had a physical office in Panama, that the staff was working from home, and that the motor vehicles had been sold. The UNDT went too far in reaching its own speculative conclusions why and how UN Women...

The UNAT held that the UNDT did not err in finding that the former staff member¡¯s change of title following a reclassification did not amount to an abolition or discontinuance of her post, rendering her termination of appointment unlawful.

The UNAT also determined that the UNDT did not err in awarding the former staff member compensation in lieu of two years¡¯ net base salary. In this regard, the UNAT emphasized that the UNDT correctly considered the fact that the former staff member¡¯s permanent appointment included a specific undertaking stating that she could only be terminated due to an...

The UNAT held that the Inspector General¡¯s Office (IGO) and the Administration failed to properly consider relevant factors brought to their attention during the investigation into the staff member's misconduct. Specifically, they did not considerate the medical context in which the established misconduct occurred, which could have been exculpatory for the staff member. The UNAT found that they failed to investigate and appreciate the potential effects of the staff member's brain tumour and/or treatment on certain aspects of his interpersonal relations with other staff members.

The UNAT held that none of the reasons provided by Mr. Hejab, considered individually or collectively, were convincing enough to consider his case exceptional, so as to warrant the award of higher compensation than set by Article 10(5) of the UNRWA DT Statute.

The UNAT held that it is not unusual for an older staff member, particularly one who is close to retirement, to have difficulty in finding another job. Likewise, although there are difficult economic conditions where he lives, this is also not the type of factor that warrants compensation in excess of the statutory norm.

The UNAT held...

The UNAT found that Article 9(4) of the UNDT Statute regarding the nature of the judicial review that the UNDT conducts in disciplinary cases did not apply to the instant case as it was adopted after the hearing was held. The parties presented their evidence, including a chronology of agreed facts as well as live testimony, and made their respective post-hearing submissions, under a legal framework where Article 9(4) was not operative and it would be inappropriate, and a denial of due process, to apply a new evidentiary framework at the point of decision, ex post facto.

The UNAT found that...

The UNAT noted that the UNDT¡¯s findings had been based on credible evidence when it determined that the staff member¡¯s son had contracted Covid-19; he had been treated under the supervision of her primary medical care provider; and payment had been made based on invoices from that provider reflecting the care he had provided.

The UNAT was of the view that in light of the testimony of the staff member¡¯s witnesses, including herself and the medical professional who had treated her son, it had not been erroneous for the UNDT to conclude that the Administration had failed to establish the medical...

The Tribunal found that the Respondent was not able to demonstrate that the facts on which the disciplinary measure was based were established by clear and convincing evidence, as otherwise required by the Appeals Tribunal in its jurisprudence.

Having found that the facts on which the disciplinary measure was based had not been established by clear and convincing evidence, the Tribunal also found that there was no established misconduct by the Applicant.

Given the finding of absence of misconduct by the Applicant, the Tribunal also rescinded the sanction imposed on him.
